OŚWIADCZENIE RZĄDOWE

z dnia 6 sierpnia 2003 r.

w sprawie mocy obowiązującej Europejskiej konwencji o koprodukcji filmowej, sporządzonej w Strasburgu dnia 2 października 1992 r.

Podaje się niniejszym do wiadomości, ze na podstawie ustawy z dnia 13 września 2002 r. o ratyfikacji Europejskiej konwencji o koprodukcji filmowej, sporządzonej w Strasburgu dnia 2 października 1992 r. (Dz. U. Nr 183, poz. 1523), Prezydent Rzeczypospolitej Polskiej dnia 23 grudnia 2002 r. ratyfikował wyżej wymienioną konwencję. Dnia 30 grudnia 2002 r. złożono do Sekretariatu Generalnego Rady Europy dokument ratyfikacyjny.

Zgodnie z art. 17 ust. 1 konwencji weszła ona w życie dnia 1 kwietnia 1994 r. W stosunku do Rzeczypospolitej Polskiej powyższa konwencja weszła w życie dnia 1 kwietnia 2003 r. Dokument ratyfikacyjny został złożony wraz z następującym zastrzeżeniem: „Ratyfikując niniejszą konwencję o koprodukcji filmowej, sporządzoną w Strasburgu dnia 2 października 1992 r., Rzeczpospolita Polska ustala maksymalny udział, określony w art. 9 ust. 1 litera a, w wysokości 40% kosztów produkcji" oraz z deklaracją złożoną zgodnie z art. 5 konwencji o treści: „Ratyfikując Europejską konwencję o koprodukcji filmowej, sporządzoną w Strasburgu dnia 2 października 1992 r., Rzeczpospolita Polska oświadcza zgodnie z art. 5 ust. 5, że właściwą władzą jest:

Republika Azerbejdżańska:

Republika Azerbejdżańska mianuje Ministerstwo Kultury właściwą władzą zgodnie z art. 5 ust. 5 konwencji.

The Republic of Azerbaijan designates the Ministry of Culture as the competent authority in accordance with Article 5, paragraph 5, of the Convention.

Królestwo Belgii:

Podpisanie przez Królestwo Belgii Europejskiej konwencji o koprodukcji filmowej nastąpiło 19 lutego 1998 r.

Brak wzmianki o tym, że podpisanie konwencji wiąże nie tylko Królestwo Belgii, ale i jego części Wspólnoty i Regiony.

19 lutego 1998 r. Stały Przedstawiciel Belgii podpisał Europejską konwencję o koprodukcji filmowej w imieniu Rządu Belgii. W okresie gdy podpisywana była konwencja, dziedzina produkcji filmowej w Belgii, zgodnie z Konstytucją, należała do wspólnych kompetencji. Zarówno Rząd Federalny, jak i części Królestwa (Wspólnoty i Regiony) dzieliły kompetencje w tej dziedzinie. Skutkiem tego podpisanie przez Stałego Przedstawiciela powinno być opatrzone adnotacją „Ten podpis wiąże również Wspólnotę Francuską, Wspólnotę Flamandzką, Wspólnotę Niemieckojęzyczną, Region Walonii, Region Flandrii i Region Bruksela – Stolica".

Brak tej wzmianki spowodował, że Rada Państwa Belgii odmówiła udzielenia opinii projektowi dekretu wyrażającego zgodę na związanie wspomnianą Konwencją do czasu, aż Belgia sprecyzuje jej partnerom w Radzie Europy, że podpisanie przez Rząd reprezentujący Królestwo Belgii wiąże jego części (Wspólnoty i Regiony).

Signature by Belgium of the European Convention on Cinematographic Co-Production on 19 February 1998 –

Failure to mention that this signature is binding nor only for the Kingdom of Belgium but for its constituents as well.

On 19 February 1998, the Permanent Representative of Belgium signed the European Convention on Cinematographic Co-Production on behalf of the Government of Belgium. At the time of this signature, the field of Cinematographic production in Belgium, according to the Constitution, was of a mixed competence, in other words, both the Federal Government and the constituents of the Kingdom (Communities and Regions) share competences in this area. Accordingly, the signature by the Permanent Representative ought to have been followed by the indication that "This signature is also binding for the French Community, the Flemish Community, the German-speaking Community, the Walloon Region, the Flemish Region and the Region of Bruxelles-Capital".

Failure to mention the above has caused the Belgian CounciI of State to refuse giving a favourable opinion to the draft decree expressing the consent to be bound by the aforementioned Convention, as long as Belgium will nor have specified to its partners in the CounciI of Europe that the signature by the Government representative of the Kingdom of Belgium is also binding upon the constituents (Communities and Regions) of the Kingdom.

Republika Cypryjska:

Zgodnie z art. 5 ust. 5 rozdziału II konwencji, Ministerstwo Spraw Wewnętrznych jest wyznaczone jako właściwa władza Republiki Cypryjskiej, która będzie wykonywała postanowienia konwencji.

In accordance with Article 5, paragraph 5, of Chapter II of the Convention, the Ministry of Interior has been designated as the competent authority of the Republic of Cyprus for the performance of the provisions of the Convention.

Rząd Republiki Francuskiej zastrzega sobie prawo objęcia działaniem konwencji wielostronnych koprodukcji zawierających jeden lub kilka udziałów mniejszościowych, które mogą być jedynie udziałami finansowymi i dla których maksymalna wartość jest inna niż określona w art. 9 ust. 1 lit. a.

Królestwo Hiszpanii:

Zgodnie z art. 5 ust. 5 Europejskiej konwencji o koprodukcji filmowej, Królestwo Hiszpanii oświadcza, że właściwą hiszpańską władzą odnośnie do artykułu 5 ust. 2 jest Instytut Kinematografii i Sztuk Audiowizualnych (Instituto de la Cinematografia y de las Artes Audiovisuales) oraz Administracje Wspólnot Autonomicznych w odniesieniu do koproducentów tam powołanych. Instytut Kinematografii i Sztuk Audiowizualnych będzie odpowiedzialny za kontakty z odpowiednimi władzami innych stron konwencji.

The Kingdom of Spain, in accordance with Article 5.5 of the European Convention on Cinematographic Co-Production, declares that the Spanish competent authority with regard to Article 5.2, is the Institute of Cinematography and Audiovisual Arts (Instituto de la Cinematografia y de las Artes Audiovisuales) and the Administrations of the Autonomous Communities in respect of co-producers who are established therein.

The Institute of Cinematography and Audiovisual Arts shall be in charge of communications with the competent authorities of the other Parties to the Convention.

Republika Litewska:

Zgodnie z art. 20 konwencji Republika Litewska zastrzega sobie prawo ustalenia maksymalnej wielkości udziału, innej niż wielkość wyszczególniona w art. 9 pkt 1 lit. a., którą określi krajowy akt prawny.

In accordance with Article 5.5 of the Convention the Government of the Republic of Lithuania has designated the Ministry of Culture as the competent authority of the Republic of Lithuania that will perform the provisions of the said Convention.

Declaration contained in the instrument of ratification deposited on 22 June 1999 and complemented by a Note Verbale from the Ministry of Foreign Affairs of the Republic of Lithuania, dated 22 November 1999, registered at the Secretariat General on 30 November 1999 (Or. Engl.).

With regard to Article 5, paragraph 5, of the Convention, Italy declares that the central authority is the "Presidenza del Consiglio – Dipartimento dello spettacolo – ROMA (Presidency of the CounciI – Department of Entertainment – ROME)".
