w sprawie zmiany Konwencji o międzynarodowym lotnictwie cywilnym,

sporządzony w Montrealu dnia 10 maja 1984 r.

W dniu 10 maja 1984 r. został sporządzony w Montrealu Protokół w sprawie zmiany Konwencji o międzynarodowym lotnictwie cywilnym w następującym brzmieniu:

w sprawie zmiany Konwencji o międzynarodowym lotnictwie cywilnym, sporządzony w Montrealu dnia 10 maja 1984 r.

Zgromadzenie Organizacji Międzynarodowego Lotnictwa Cywilnego

na swojej dwudziestej piątej sesji (nadzwyczajnej) w Montrealu w dniu 10 maja 1984 r.,

uznając, że międzynarodowe lotnictwo cywilne może znacząco pomóc w tworzeniu i utrzymaniu stosunków przyjaźni i wzajemnego zrozumienia narodów i świata, choć jego nadużycie może stać się zagrożeniem dla bezpieczeństwa ogólnego,

uznając, że pożądane jest unikanie zatargów i promowanie współpracy między narodami, od czego zależy pokój światowy,

uznając, że konieczne jest, aby międzynarodowe lotnictwo cywilne mogło rozwijać się w sposób bezpieczny i prawidłowy,

uznając, że zgodnie z podstawowymi zasadami humanitaryzmu musi być zagwarantowane bezpieczeństwo i życie osób na pokładzie cywilnego statku powietrznego,

uznając, że w Konwencji o międzynarodowym lotnictwie cywilnym, sporządzonej w Chicago dnia 7 grudnia 1944 r., Umawiające się Państwa

– uznają, że każde państwo posiada całkowitą i wyłączną suwerenność w przestrzeni powietrznej nad swoim terytorium,

– podejmują się, przy wydawaniu przepisów dotyczących swoich państwowych statków powietrznych, odpowiednio uwzględniać bezpieczeństwo żeglugi cywilnych statków powietrznych i

– zgadzają się nie używać lotnictwa cywilnego do jakichkolwiek celów niezgodnych z celami konwencji,

uznając determinację Umawiających się Państw w podejmowaniu właściwych środków dla zapobiegania aktom naruszania przestrzeni powietrznej innych państw i używania lotnictwa cywilnego dla celów niezgodnych z konwencją oraz dla poprawy bezpieczeństwa międzynarodowego lotnictwa cywilnego,

uznając ogólne dążenie Umawiających się Państw do potwierdzenia zasady niestosowania broni przeciwko cywilnym statkom powietrznym w locie,

1. Decyduje, że wskazana jest stąd zmiana Konwencji o międzynarodowym lotnictwie cywilnym, sporządzonej w Chicago 7 grudnia 1944 r.;

2. Zatwierdza, zgodnie z przepisem artykułu 94 (a) wyżej wymienionej konwencji, następującą proponowaną zmianę do tej konwencji:

dodanie po artykule 3, nowego artykułu 3 bis:

„Artykuł 3 bis

a) Umawiające się Państwa uznają, że każde Państwo musi powstrzymać się od uciekania się do użycia broni przeciwko cywilnemu statkowi powietrznemu w locie oraz że w przypadku przechwycenia życie osób na pokładzie i bezpieczeństwo statku powietrznego nie mogą być zagrożone. Przepis ten nie powinien być interpretowany tak, aby zmieniał w jakikolwiek sposób prawa i zobowiązania państw ustanowione w Karcie Narodów Zjednoczonych.

b) Umawiające się Państwa uznają, że każde Państwo, korzystając z praw swojej suwerenności, jest uprawnione do żądania lądowania w jakimś wyznaczonym porcie lotniczym cywilnego statku powietrznego przelatującego nad jego terytorium bez zezwolenia albo jeśli są racjonalne podstawy do stwierdzenia, że jest on używany w jakimkolwiek celu niezgodnym z konwencją; może także przekazać takiemu statkowi powietrznemu wszelkie inne polecenia mające na celu zaprzestanie tych naruszeń. W tym celu Umawiające się Państwa mogą uciec się do wszelkich stosownych środków zgodnych z odnośnymi zasadami prawa międzynarodowego, łącznie z odpowiednimi postanowieniami konwencji, a szczególnie ustępu a) niniejszego artykułu. Każde Umawiające się Państwo zgadza się na publikowanie swoich obowiązujących przepisów odnoszących się do przechwycenia statku powietrznego.

c) Każdy cywilny statek powietrzny zastosuje się do polecenia wydanego zgodnie z ustępem b) niniejszego artykułu. W tym celu każde Umawiające się Państwo ustanowi wszelkie niezbędne postanowienia w ustawach lub przepisach krajowych, tak aby były one wiążące dla każdego cywilnego statku powietrznego zarejestrowanego w tym państwie lub eksploatowanego przez operatora, który ma swoje główne miejsce działalności lub miejsce stałego pobytu w tym państwie. Każde Umawiające się Państwo traktować będzie jakiekolwiek naruszenie ustaw lub przepisów jako karalne poprzez nakładanie surowej kary i przekazywać będzie opisy takich przypadków kompetentnym organom zgodnie z obowiązującymi przepisami.

d) Każde Umawiające się Państwo podejmie odpowiednie środki zakazujące umyślnego użycia jakiegokolwiek statku powietrznego zarejestrowanego w tym państwie lub użytkowanego przez operatora, który ma swoje główne miejsce działalności lub miejsce stałego pobytu w tym państwie, dla jakiegokolwiek celu niezgodnego z niniejszą konwencją. Postanowienie niniejsze nie ma wpływu na postanowienia ustępu a) ani nie uchyla postanowień ustępu b) i c) niniejszego artykułu.”;

3. Ustala, zgodnie z przepisem wyżej wymienionego artykułu 94(a) konwencji, liczbę 102 Umawiających się Państw, których ratyfikacja proponowanej zmiany jest konieczna do jej wejścia w życie.

4. Postanawia, że Sekretarz Generalny Organizacji Międzynarodowego Lotnictwa Cywilnego sporządzi protokół w językach angielskim, francuskim, rosyjskim i hiszpańskim, każdy z nich jednakowo autentyczny, które będą zawierały wyżej wymienioną proponowaną zmianę oraz informacje wymienione niżej:

a) protokół będzie podpisany przez Przewodniczącego Zgromadzenia i jego Sekretarza Generalnego,

b) protokół będzie otwarty do ratyfikacji przez każde Państwo, które ratyfikowało lub przystąpiło do wyżej wymienionej Konwencji o międzynarodowym lotnictwie cywilnym,

c) dokumenty ratyfikacyjne będą składane w depozycie Organizacji Międzynarodowego Lotnictwa Cywilnego,

d) protokół wejdzie w życie w odniesieniu do państw, które go ratyfikowały, w dniu złożenia sto drugiego dokumentu ratyfikacyjnego,

e) Sekretarz Generalny bezzwłocznie powiadomi wszystkie Umawiające się Państwa o dacie złożenia w depozycie każdego dokumentu ratyfikacyjnego protokołu,

f) Sekretarz Generalny powiadomi wszystkie państwa-strony wymienionej konwencji o dacie wejścia w życie protokołu,

g) w odniesieniu do każdego państwa, które ratyfikuje protokół po wyżej wymienionym terminie, protokół wejdzie w życie po złożeniu przez nie dokumentu ratyfikacyjnego w depozycie Organizacji Międzynarodowego Lotnictwa Cywilnego.

W konsekwencji, zgodnie z wyżej omówionym działaniem Zgromadzenia,

niniejszy protokół został sporządzony przez Sekretarza Generalnego Organizacji.

Na dowód czego, Przewodniczący i Sekretarz Generalny wyżej wymienionej dwudziestej piątej (nadzwyczajnej) sesji Zgromadzenia Organizacji Międzynarodowego Lotnictwa Cywilnego, będąc do tego upoważnieni przez Zgromadzenie, podpisują niniejszy protokół.

Sporządzono w Montrealu dnia 10 maja tysiąc dziewięćset osiemdziesiątego czwartego roku w jednym egzemplarzu w językach angielskim, francuskim, rosyjskim i hiszpańskim, z których każdy jest jednakowo autentyczny. Niniejszy protokół będzie przechowywany w depozycie w archiwach Organizacji Międzynarodowego Lotnictwa Cywilnego, a jego poświadczone kopie będą rozesłane przez Sekretarza Generalnego Organizacji do wszystkich państw-stron Konwencji o międzynarodowym lotnictwie cywilnym, sporządzonej w Chicago dnia siódmego grudnia 1944 r.

PROTOCOL

relating to an amendment to the Convention on International Civil Aviation signed at Montreal on 10 May 1984

The assembly of the International Civil Aviation Organization

having met in its Twenty-fifth Session (Extraordinary) at Montreal on 10 May 1984,

having noted that international civil aviation can greatly help to create and preserve friendship and understanding among the nations and peoples of the world, yet its abuse can become a threat to general security,

having noted that it is desirable to avoid friction and to promote that cooperation between nations and peoples upon which the peace of the world depends,

having noted that it is necessary that international civil aviation may be developed in a safe and orderly manner,

having noted that in keeping with elementary considerations of humanity the safety and the lives of persons on board civil aircraft must be assured,

having noted that in the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944 the contracting States

– recognize that every State has complete and exclusive sovereignty over the airspace above its territory,

– undertake, when issuing regulations for their state aircraft, that they will have due regard for the safety of navigation of civil aircraft, and

– agree not to use civil aviation for any purpose inconsistent with the aims of the Convention,

having noted the resoIve of the contracting States to take appropriate measures designed to prevent the violation of other States’ airspace and the use of civil aviation for purposes inconsistent with the aims of the Convention and to enhance further the safety of international civil aviation,

having noted the general desire of contracting States to reaffirm the principle of non-use of weapons against civil aircraft in flight,

1. Decides that it is desirable therefore to amend the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,

2. Approves, in accordance with the provision of Article 94(a) of the Convention aforesaid, the following proposed amendment to the sald Convention:

Insert, after Article 3, a new Article 3 bis:

„Article 3 bis

(a) The contracting States recognize that every State must refrain from resorting to the use of weapons against civil aircraft in flight and that, in case of interception, the lives of persons on board and the safety of aircraft must not be endangered. This provision shall not be interpreted as modifying in any way the rights and obligations of States set forth in the Charter of the United Nations.

(b) The contracting States recognize that every State, in the exercise of its sovereignty, is entitled to require the landing at some designated airport of a civil aircraft flying above its territory without authority or if there are reasonable grounds to conclude that it is being used for any purpose inconsistent with the aims of this Convention; it may also give such aircraft any other instructions to put an end to such violations. For this purpose, the contracting States may resort to any appropriate means consistent with relevant rules of International law, including the relevant provisions of this Convention, specifically paragraph (a) of this Article. Each contracting State agrees to publish its regulations in force regarding the interception of civil aircraft.

(c) Every civil aircraft shall comply with an order given in conformity with paragraph (b) of this Article. To this end each contracting State shall establish all necessary provisions in its national laws or regulations to make such compliance mandatory for any civil aircraft registered in that State or operated by an operator who has his principal place of business or permanent residence in that State. Each contracting State shall make any violation of such applicable laws or regulations punishable by severe penalties and shall submit the case to its competent authorities in accordance with its laws or regulations.

(d) Each contracting State shall take appropriate measures to prohibit the deliberate use of any civil aircraft registered in that State or operated by an operator who has his principal place of business or permanent residence in that State for any purpose inconsistent with the aims of this Convention. This provision shall not affect paragraph (a) or derogate from paragraphs (b) and (c) of this Article.”,

3. Specifies, pursuant to the provision of the sald Article 94(a) of the said Convention, one hundred and two as the number of contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and

4. Resolves that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above-mentioned and the matter hereinafter appearing:

a) The Protocol shall be signed by the President of the Assembly and its Secretary General.

b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation.

c) The instruments of ratification shall be deposited with the International Civil Aviation Organization.

d) The Protocol shall come finto force in respect of the States which have ratified it on the date on which the one hundred and second instrument of ratification is so deposited.

e) The Secretary General shall immediately notify all contracting States of the date of deposit of each ratification of the Protocol.

f) The Secretary General shall notify all States parties to the said Convention of the date on which the Protocol comes into force.

g) With respect to any contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

Consequently, pursuant to the aforesaid action of the Assembly,

This Protocol has been drawn up by the Secretary General of the Organization.

In witness whereof, the President and the Secretary General of the aforesaid Twenty-fifth Session (Extraordinary) of the Assembly of the International Civil Aviation Organization, being authorized thereto by the Assembly, sign this Protocol.

Done at Montreal on the 10th day of May of the year one thousand nine hundred and eighty-four, in a single document in the English, French, Russian and Spanish languages, each text being equally authentic. This Protocol shall remain deposited in the archives of the International Civil Aviation Organization, and certified copies thereof shall be transmitted by the Secretary General of the Organization to all States parties to the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944.

portant amendement de la Convention relative à I’Aviation civile internationale signé à Montréal le 10 mai 1984

L’assemblée de I’Organisation de I’Aviation civile internationale,

s’étant réunie a Montreal, le 10 mai 1984, en sa vingt-cinquième session ·extraordinaire),

ayant pris acte que I’aviation civile internationale peut grandement aider à creer et a préserver entre les nations et les peuples du monde I’amitié et la compréhension, alors que tout abus qui en serait fajt peut devenir une menace pour la sécurité générale,

ayant pris acte qu’il est désirable d’éviter toute mésentente entre les nations et les peuples et de promouvoir entre eux la coopération dont dépend la paix du monde,

ayant pris acte qu’il est nécessaire que I’aviation civile internationale puisse se développer de maniére sûre et ordonnée,

ayant pris acte que, conformément aux considérations élémentaires d’humanité, la sécurité et la vie des personnes se trouvant à bord des aéronefs civils doivent être assurées,

ayant pris acte du fait que, dans la Convention relative à I’Aviation civile internationale faite a Chicago le 7 décembre 1944, les États contractants

– reconnaissent que chaque État a la souveraineté complète et exclusive sur I’espace aérien au-dessus de son territoire,

– s’engagent à tenir dûment compte de la sécurité de la navigation des aéronefs civils lorsqu’ils établissent des règlements pour leurs aéronefs d’État, et

– conviennent de ne pas employer I’aviation civile à des fins incompatibles avec les buts de la Convention,

Ayant pris acte de la détermination des États contractants de prendre des mesures appropriées visant à empêcher la violation de I’espace aérien des autres États et I’utilisation de I’aviation civile à des fins incompatibles avec les buts de la Convention et de renforcer la sécurité de I’aviation civile internationale,

Ayant pris acte du désir général des États contractants de réaffirmer le principe du non-recours à I’emploi des armes contre les aéronefs civils en vol,

1. Décide qu’il est souhaitable d’amender en conséquence la Convention relative à I’Aviation civile internationale, faite à Chicago le 7 décembre 1944,

2. Approuve, conformément aux dispositions de I’article 94, alinéa a), de la Convention mentionnée ci-dessus, I’amendement ciaprès qu’il est proposé d’apporter à ladite Convention:

insérer, après I’article 3, un nouvel article 3 bis:

„Article 3 bis

a) Les États contractants reconnaissent que chaque État doit s’abstenir de recourir à I’emploi des armes contre les aéronefs civils en vol et qu’en cas d’interception, la vie des personnes se trouvant à bord des aéronefs et la sécurité des aéronefs ne doivent pas être mises en danger. Cette disposition ne saurait être interpretée comme modifiant de quelque manière que ce soit les droits et obligations des États en vertu de la Charte des Nations Unies.

b) Les États contractants reconnaissent que chaque État, dans I’exercice de sa souveraineté, est en droit d’exiger I’atterrissage, à un aéroport désigné, d’un aéronef civil qui, sans titre, survole son territoire ou s’il y a des motifs raisonnables de conclure qu’il est utilisé à des fins incompatibles avec les buts de la présente Convention; il peut aussi donner à cet aéronef toutes autres instructions pour mettre fin à ces violations. À cet effet, les États contractants peuvent recourir à tous moyens appropriés compatibles avec les règles pertinentes du droit International, y compris les dispositions pertinentes de la présente Convention, spécifiquement I’alinéa a) du présent article. Chaque État contractant convient de publier ses règlements en vigueur pour I’interception des aéronefs civils.

c) Tout aéronef civil doit respecter un ordre donné conformément à I’alinéa b) du présent article. À cette fin, chaque État contractant prend toutes les mesures nécessaires dans ses lois ou règlements nationaux pour faire obligation à tout aéronef immatriculé dans ledit État ou utilisé par un exploitant qui à le siège principal de son exploitation ou sa résidence permanente dans ledit État de se conformer à cet ordre. Chaque État contractant rend toute violation de ces lois ou règlements applicables passible de sanctions sévères et soumet I’affaire à ses autorités compétentes conformément à son droit interne.

d) Chaque État contractant prendra des mesures appropriées pour interdire I’emploi délibéré de tout aéronef civil immatriculé dans ledit État ou utilisé par un exploitant qui a le siège principal de son exploitation ou sa résidence pęrmanente dans ledit État à des fins incompatibles avec les buts de la présente Convention. Cette disposition ne porte pas atteinte à I’alinéa a) et ne déroge pas aux alineas b) et c) du présent article.”,

3. Fixe, conformément à la disposition dudit article 94, alinéa a), de ladite Convention, à cent deux le nombre d’États contractants dont la ratification est nécessaire à I’entrée en vigueur dudit amendement, et

4. Décide que le Secrétaire général de I”Organisation de I’Aviation civile internationale établira en langues française, anglaise, espagnole et russe, chacune faisant également foi, un protocole concernant I’amendement précité et comprenant les dispositions ci-dessous:

a) Le protocole sera signé par le Président et le Secrétaire général de I’Assemblée.

b) Le protocole sera ouvert à la ratification de tout Etat qui aura ratifié la Convention relative à I’Aviation civile internationale ou y aura adhéré.

c) Les instruments de ratification seront déposés auprès de I’Organisation de I’Aviation civile internationale.

d) Le protocole entrera en vigueur à I’egard des États qui f’auront ratifié le jour du dépôt du cent deuxieme instrument de ratification.

e) Le Secrétaire général notifiera immèdiatement à tous les États contractants la date du dépôt de chaque instrument de ratification du protocole.

f) Le Secrétaire général notifiera immédiatement à tous les États qui sont parties à ladite Convention la date à laquelle ledit protocole entrera en vigueur.

g) Le protocole entrera en vigueur, à I’égard de tout État contractant qui I’aura ratifié après la date précitée, dès que cet Etat aura déposé son instrument de ratification auprès de I’Organisation de I’Aviation civile internationale.

En Conséquence,conformément à la décision ci-dessus de I’Assemblée,

Le présent protocole a été établi par le Secrétaire genéral de I’Organisation.

En foi de quoi, le Président et le Secrètaire général de la vingt-cin-quième session (extraordinaire) de I’Assemblée de I’Organisation de I’Aviation civile internationale, dûment autorisés à cet effet par I’Assemblée, ont apposé leur signature au présent protocole.

Fait à Montreal le 10 mai de I’an mil neuf cent quatre-vingt-quatre, en un seul document dans les langues française, anglaise, espagnole et russe, chacun des textes faisant également foi. Le présent protocole sera déposé dans les archives de I’Organisation de I’Aviation civile internationale et des copies certifiées conformes seront transmises par le Secrétaire général de I’Organisation à tous les États parties à la Convention relative à I’Aviation civile internationale faite à Chicago le 7 Décembre 1944.

relativo a una enmienda al Convenio sobre Aviación Civil Internacional firmado en Montreal el 10 de mayo de 1984

La asamblea de la Organizacion de Aviacion Civil Internacional,

habiendose reunido en su vigésimo quinto período de sesiones (extraordinario) en Montreal el 10 de mayo de 1984,

habiendo tornado nota de que la aviación civil internacional puede contribuir poderosamente a crear y a preservar la amistad y el entendimiento entre las naciones y los pueblos del mundo, mientras que el abuso de la misma puede Ilegar a constituir una amenaza a la seguridad general,

habiendo tornado nota de que es deseable evitar toda disensión entre las naciones y los pueblos y promover entre ellos la cooperación de que depende la paz del mundo,

habiendo tornado nota de que es necesario que la aviación civil internacional pueda desarrollarse de manera segura y ordenada,

habiendo tornado nota de que, con arreglo a consideraciones humanitarias elementales, debe garantizarse la seguridad y la vida de las personas a bordo de las aeronaves civiles,

habiendo tornado nota de que en el Convenio sobre Aviación Civil Internacional, hecho en Chicago el día 7 de diciembre de 1944, los Estados contratantes

– reconocen que todo Estado tiene soberanía plena y exclusiva en el espacio aéreo situado sobre su territorio,

– se comprometen a tener debidamente en cuenta la seguridad de la navegación de las aeronaves civiles cuando establezcan reglamentos aplicables a sus aeronaves de Estado, y

– convienen en no emplear la aviación civil para propósitos incompatibles con los fines del Convenio,

Habiendo tornado nota de que los Estados contratantes han resuelto tomar medidas apropiadas para evitar que se viole el espacio aéreo de otros Estados y que la aviación civil se emplee para propósitos incompatibles con los fines del presente Convenio, asi como para intensificar aun mas la seguridad de la aviación civil internacional,

Habiendo tornado nota de que es el deseo general de los Estados contratantes ratificar el principio de no recurrir a las armas en contra de las aeronaves civiles, en vuelo,

1. Decide que, en consecuencia, es conveniente enmendar el Convenio sobre Aviación Civil Internacional hecho en Chicago el día 7 de diciembre de 1944,

2. Aprueba, de conformidad con las disposiciones del Artículo 94 a) del referido Convenio, la siguiente enmienda propuesta al mismo:

Insertese, despues del Articulo 3, un nuevo Artfculo 3 bis del tenor siguiente:

„Articulo 3 bis

a) Los Estados contratantes reconocen que todo Estado debe abstenerse de recurrir al uso de las armas en contra de las aeronaves civiles en vuelo y que, en caso de interceptación, no debe ponerse en peligro la vida de los ocupantes de las aeronaves ni la seguridad de éstas. La presente disposición no se interpretará en el sentido de que modifica en modo alguno los derechos y las obligaciones de los Estados estipulados en la Carta de las Naciones Unidas.

b) Los Estados contratantes reconocen que todo Estado tiene derecho, en el ejercicio de su soberania, a exigir el aterrizaje en un aeropuerto designado de una aeronave civil que sobrevuele su territorio sin estar facultada para ello, o si tiene motivos razonables para Ilegar a la conclusión de que se utiliza para propósitos incompatibles con los fines del presente Convenio; asimismo puede dar a dicha aeronave toda otra instrucción necesaria para poner fin a este acto de violación. A tales efectos, los Estados contratantes padrán recurrir a todos los medios apropiados compatibles con los preceptos pertinentes del derecho internacional, comprendidas las disposiciones pertinentes del presente Convenio y, especificamente, con el parrafo a) del presente Articulo. Cada Estado contratante conviene en publicar sus reglamentos vigentes en materia de interceptación de aeronaves civiles.

c) Toda aeronave civil acatará una orden dada de conformidad con el párrafo b) del presente Artículo. A este fin, cada Estado contratante incorporará en su legislación o reglamentación todas las disposiciones necesarias para que toda aeronave civil matriculada en èl o explotada por un explotador cuya oficina principal o residencia permanente se encuentre en su territorio, tenga la obligación de acatar dicha orden. Cada Estado contratante tomará las disposiciones necesarias para que toda violación de esas leyes o reglamentos aplicables se castigue con sanciones severas, y someterá el caso a sus autoridades competentes de conformidad con las leyes nacionales.

d) Cada Estado contratante tomará medidas apropiadas para prohibir el uso deliberado de aeronaves civiles matriculadas en dicho Estado o explotadas por un explotador que tenga su oficina principal o su residencia permanente en dicho Estado, para cualquier propósito incompatible con los fines del presente Convenio. Esta disposición no afectará al párrafo a) ni derogará los párrafos b) y c) del presente Artículo.”,

3. Prescribe, de conformidad con la disposición de dicho Artículo 94 a) del mencionado Convenio, que el número de Estados contratantes cuya ratificación se requerirá para que la enmienda propuesta anteriormente entre en wigor, será de ciento dos, y

4. Resuelve que el Secretario General de la Organización de Aviación Civil Internacional redacte un Protocolo en los idiomas español, francés, inglés y ruso, teniendo cada texto igual autenticidad, en el que se incorpore la enmienda propuesta mencionada, así como 10 expuesto a continuación:

a) EI Protocolo ostentará las firmas del Presidente de la Asamblea y de su Secretario General.

b) EI Protocolo quedará abierto a la ratificación de todo Estado que haya ratificado el citado Convenio sobre Aviación Civil Internacional o se haya adherido al mismo.

c) Los instrumentos de ratificación se depositaran en la Organización de Aviación Civil Internacional.

d) El Protocolo entrará en wigor para los Estados que lo hayan ratificado en la fecha en que se deposite el centésimo segundo instrumento de ratificación.

e) EI Secretario General notificará inmediatamente a todos los Estados contratantes la fecha de depósito de cada ratificación del Protocolo.

f) EI Secretario General notificará inmediatamente a todos los Estados Partes en dicho Convenio la fecha de entrada en wigor del Protocolo.

g) Con respecto a cual quier Estado contratante que ratifique el Protocolo después de la fecha anteriormente referida, el Protocolo entrará en vigor a partir del depósito de su instrumento de ratificación en la Organización de Aviación Civil International.

Por Consiguiente, envirtud de la decisión antes mencionada de la Asamblea,

Este Protocolo ha sido redactado por el Secretario General de la Organización.

En testimonio de lo cual, el Presidente y el Secretario General del mencionado vigésimo quinto período de sesiones (extraordinario) de la Asamblea de la Organización de Aviación Civil Internacional, debidamente autorizados por la Asamblea, firman el presente Protocolo.

Hecho en Montreal el 10 de mayo de mil novecientos ochenta y cuatro en un documento único redactado en los idiomas español, francés, inglés y ruso, teniendo cada texto igual autenticidad. EI presente Protocolo quedará depositado en los archivos de la Organización de Aviación Civil Internacional, y el Secretario General de esta Organización transmitirá copias certificadas, conformes, del mismo, a todos los Estados Partes en el Convenio sobre Aviación Civil Internacional hecho en Chicago el 7 de diciembre de 1944.

Po zapoznaniu się z powyższym protokołem, w imieniu Rzeczypospolitej Polskiej oświadczam, że:

– został on uznany za słuszny zarówno w całości, jak i każde z postanowień w nim zawartych,

– jest przyjęty, ratyfikowany i potwierdzony,

– będzie niezmiennie zachowywany.

Na dowód czego wydany został akt niniejszy, opatrzony pieczęcią Rzeczypospolitej Polskiej.
